The Commission certifies mediation training programs for purposes of the 40-hour superior court mediation training requirement set forth in Mediated Settlement Conference (MSC) Rule 8.A., the 40-hour family training requirement set forth in Family Financial Settlement (FFS) Rule 8.A.2., and the 10-hour requirment set forth in Clerk Mediation Program Rule (CMP) Rule 8.B. The Commission has also certified training programs to provide the six-hour course on North Carolina court structure, civil procedure and legal terminology required of non-attorney applicants for certification by MSC Rule 8.B. (2)(a) and FFS Rule 8.B.
All training programs applying for certification are required to submit a detailed agenda showing the time devoted to each discussion item listed. A considerable portion of the agenda for a 40-hour course must be devoted to discussing the core curriculum topics listed in MSC Rule 9 and FFS Rule 9. A considerable portion of the curriculum for the 10-hour estate and guardianship mediator training program must be devoted to the curriculum topics listed in CMP Rule 9. The Commission also expects that 40-hour training programs will reflect the North Carolina experience, discussing this State's statutes, rules and practices and providing participants with an opportunity to observe and to model the approach to mediation that has evolved in this State, e.g., inclusion of the parties' attorneys, reliance on caucusing. All trainers must also submit resumes for principal trainers and copies of all handouts given to participants. Forty-hour programs must also supply all role-play scenarios that will be given to participants.
